This agreement is entered into by Horse Owner and Lessee. Horse Owner warrants that it is the owner of the horse and
agrees to lease said horse to Lessee subject to the following terms and conditions; and whereas, Lessee warrants that
she/he agrees to lease said horse subject to the following terms and conditions. The Parties agree as follows:
2. Term
The term of this lease shall commence on _____________, 20____ and terminate on ___________________, 20____,
unless the Parties agree in writing to continue the terms of this lease, in which case the new lease term shall be set forth
in an amendment and attached hereto, signed and dated by both Parties representatives, and these same terms and
conditions shall apply thereto unless modified in amendment.

4. Location
Horse shall be located at _________________________________________________________________________
for the duration of the lease. Lessee shall not have the right to relocate said horse with out Horse Owner's express
written permission (which shall be attached here and signed and dated by both Parties). Exception #1: If horse must
have emergency veterinary care, it may be relocated to veterinary clinic/hospital immediately and Lessee agrees to
notify Horse Owner with in 24 hours of horse's new location (actual address) and reason for veterinary treatment.
Exception #2: Horse may be taken to scheduled shows and may be temporarily relocated to show venue for the duration
of the show only. Lessee agrees to provide Horse Owner with written schedule to include Show Name, Show dates and
Show location (physical address) at least 7 days prior to actual show.
5. Limitations and Use of Horse
Lessee covenants, warrants and agrees NOT to use the horse for any purpose(s) other than those set forth here: mare
may be bred to stallion of Lessee's choice at Lessee's expense for a resulting 20____ and 20____ foal. Ownership of
20____ and 20____ foal(s) will go to Lessee upon honoring all terms of this agreement. Lessee agrees to humanely
train mare to ride and ride on a regular basis as the lease fee. Lessee may show or compete mare if desired at Lessee's
expense and agrees to provide Horse Owner with written times, dates, locations and purpose of show or competition if
shown or competed. Lessee agrees to bar any riders except Lessee, Lessee's Trainer, Riding Instructor or other
professional where appropriate.
6. Lessee Responsibilities
Lessee is solely responsible for any veterinary expenses related to care and shipping of leased horse. Lessee is
responsible for transportation at the beginning of the lease, and at the end of the lease back to Shatormar Arabians.
Lessee is responsible for reasonable daily care of horse during lease period to maintain a body condition ( Henneke
Body Condition Scoring System) of a minimum of 5 (ideal body weight), adequate food, shelter and fresh water, farrier
services as needed to maintain proper hoof length and veterinary services as needed.
7. Ownership Registration
Horse Owner warrants that said horse is free from any liens or encumbrances. The horse included in this lease shall
remain the sold property of the Horse Owner, and the Lessee shall have no right, title, or loan to any other party of said
horse except as stated herein. Lessee shall not loan, lease or otherwise transfer the horse, or any right in the horse, to
any third party with out written consent of Horse Owner, which consent may be withheld at Horse Owner's sold
discretion. Horse Owner will provide signed AHA registration form, Assignment of Breeder form and Transfer of Eligible
but Unregistered Foal for the 20____ and 20____ foal(s) out of the leased mare.
8. Covenant Not to Encumber
Lessee agrees not to encumber said horse with any lien, charge, or related claim and to indemnify, defend and hold
harmless Horse Owner therefrom.
9. Risk of Loss and Insurance
Lessee assumes risk of lose or injury to said horse. Horse Owner shall not be held responsible for loss, damage, injury,
claim, demand, cost and expenses (including legal expenses) arising out of or connected with the use of the horse,
whether by Lessee or any other person. Horse Owner will not be responsible for any accident or injury to any person,
animal or property that comes in contact with the above named horse during the term of this lease. In the event horse
dies or is seriously maimed or injured resulting in loss of use during the lease period, Lessee agrees to compensate
Horse Owner by replacing leased horse with a registered filly/mare of similar breeding and quality (Horse Owner must
approve of the replacement) or may carry insurance on leased horse at their own expense for the full replacement value
of said horse.
10. Option to Renew Lease
Lessee may have the option to renew this lease if requested is made in writing thirty days prior to the expiration of the
term of this lease, provided, however, that said horse is available for lease. Any such exercise of option, if any, shall be
confirmed in writing by the Parties, and attached hereto as an amendment. Any renewed lease shall have the same
terms, conditions and agreements herein.
11. Default
Lessee agrees to humanely train horse to ride and ride on a consistent basis during lease period. Failure to train horse
in the minimum basics (stand calm while being saddled and mounted; walk, trot, canter, gallop under saddle; lead
changes; backing up while ridden, etc). will result in material breach of contract and Lessee agrees to pay the fee of
$3000 per year if horse is not trained in the basics listed here. Lessee agrees to keep horse in fit condition (Henneke
Body Condition Scoring System of 5 or above) or Horse Owner may terminate this agreement with 24 hour notice by
phone, mail or email, repossess leased horse (including the right to access Lessee's property to remove horse and any
foal at heel) and Lessee grants ownership of any foal at heel or in utero to Horse Owner if repossessed.
12. Agreement
This agreement constitutes the entire agreement between the Parties. Any modifications or additions must be in writing
and signed and dated by all Parties to this agreement. No oral modifications will be considered part of this agreement
unless reproduced in writing and signed by all parties.
13. Law
This agreement is governed by the laws of the state of Pennsylvania. Any dispute or claim that arises out of, or that
relates to this agreement, or to the interpretation or breach thereof, or the existence, scope, or validity of this agreement
or the arbitration agreement, shall be resolved by arbitration in this same state, and any judgment upon the award
rendered pursuant to such arbitration may be entered in any court having jurisdiction there of.
